AGREEMENT BETWEEN USER AND THE CALAIS SCHOOL (“Calais School”, “Calais”, “us”, “we”, or “our”) offers this www.thecalaisschool.org (the “Site”) to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (“Agreement”).

Your use of the Site constitutes your agreement to all such terms, conditions, and notices.

Introduction

Please read the Agreement carefully before using the Site or the Blog. This Agreement sets forth the legally binding terms and conditions for your use of the Site and the Blog.

The Site and Blog are complimentary information services offered by The Calais School at no charge to users of the World Wide Web, with the express condition that these users agree to be bound by the terms and conditions set forth in this Agreement.

The Calais School has no obligation to monitor the Discussions. However, The Calais School reserves the right in its sole discretion to review materials posted to a Discussions(s) and to remove any materials at any time, for any reason, without notice to you. The Calais School reserves the right to terminate your access to any or all of the Discussions at any time without notice for any reason whatsoever.

The Calais School reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in The Calais School’s sole discretion.

The Calais School is dedicated to promoting the most effective special education experience through its educational and support services. The Calais School therefore encourages and permits links to our Site and Blog that support this mission. As such, The Calais School allows external, hyper-text links to Site, provided:

  • any text-only link must clearly be marked “The Calais School”;
  • the appearance, position and other aspects of either the link or the host website may not be such as to damage or dilute the goodwill associated with The Calais School’s name, programs and trademarks;

  2. The Calais School does NOT endorse companies, products or services and strictly prohibits the suggestion of endorsement, recommendation, or superiority of one company, product or service over another company, product or service.
  3. A Sponsor’s logo and link may not reside on The Calais School’s program-related pages, with the exception of fundraising activities.
  4. When The Calais School’s Site or Blog includes links to other sites, the Calais does not assume any responsibility or liability for any communications or materials available at the sites to which it links, including responsibility or liability for their accuracy. No link on Calais’s Website or Blog is a referral or endorsement of either the linked-to entity or any product or service.
  5. Calais will provide links from its Website and Blogs to others where there is mutual benefit, either formalized in an agreement or by an informal understanding.

Restricted access

Access to certain areas of this Site is restricted. The Calais School reserves the right to restrict access to areas of this Site, or indeed this entire Site, at our discretion.

If The Calais School provides you with a user ID and password to enable you to access restricted areas of this Site, you must ensure that the user ID and password are kept confidential.

The Calais School may disable your user ID and password in our sole discretion without notice or explanation.
Termination

We may, in our sole discretion, terminate your access to the Site and/or Blog for any reason, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. General

To the maximum extent permitted by law, this Agreement is governed by the laws of the State of New Jersey and you hereby consent to the exclusive jurisdiction and venue of courts in New Jersey in all disputes arising out of or relating to the use of the Site or Blog.

Use of the Site or Blog is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and The Calais School as a result of this Agreement or use of the Site or Blog.

The Calais School’s performance of this Agreement is subject to existing laws and legal process, and nothing contained in this Agreement is in derogation of The Calais School’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or Blog or information provided to or gathered by The Calais School’s with respect to such use.

If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this Agreement shall continue in effect.

Unless otherwise specified herein or agreed to by the user, this Agreement constitutes the entire agreement between the user and The Calais School with respect to the Site or Blog and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and The Calais School with respect to the Site or Blog. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
